Policies, Disclaimers, Rules, and Fees

Code of Conduct

Students are required to complete 100% of program requirements, commit to and follow the ICF Code of Ethics.

Participants are expected to conduct themselves in a professional manner during all sessions. This includes, but is not limited to:

  • Arriving on time to all sessions.
  • Attending all live sessions and mentor coaching sessions.
  • Having your camera on for virtual live sessions.
  • Participating fully in all sessions and mentor coaching sessions. This includes being prepared for the session, involving yourself in discussions and activities, assuming responsibility for your learning, and contributing to the learning of others.
  • Engaging in discussions with integrity and honesty.
  • Being respectful of your fellow participants and instructors, including silencing your cell phone, not texting, and other disruptive behaviors.
  • Embracing diversity and inclusion while respecting the dignity and humanity of others.

Application Fees

Application fees are nonrefundable.


Refund Policy

Cancellation of a course must be made a minimum of 21 business days prior to the course to be eligible for a 90% refund. Cancellations made 20 business days or less before the course are not eligible for a refund. Written notice of cancellation shall be effective on the date the withdrawal is received by Blue Mesa Coaching. Refunds will be made within 10 business days following receipt of cancellation or withdrawal requests.

A participant’s dismissal from the program may be for any reason and is at the Program Director’s sole and absolute discretion.  The refund policy set forth above shall be the participant’s only recourse, and participants shall not be entitled to any other remuneration upon leaving or being dismissed from the program, including but not limited to consequential damages.

Introduction: Our commitment to your privacy

McMillan Barlow Group, LLC . dba Blue Mesa Coaching (‘BMC’) is highly sensitive to the confidentiality of information provided by you to BMC. As a result, BMC has adopted the following Privacy Policy which is applicable to all information that you provide to BMC and which BMC maintains electronically, whether you provide the information through BMC’s website (the ‘Site’) or through other means. This Policy does not apply to any information that you may provide to third parties, such as through other sites linked to the BMC Site. You should contact such third parties directly to determine their respective Privacy Policies.

BMC expressly reserves in its sole discretion, and at times and intervals of its choosing, the right to change its Policies and Practices periodically in the future without prior notice to Site Users. You should review our Privacy Policy Statement regularly to be sure you are fully current with our practices and procedures in this area. At present, BMC uses and discloses the information provided by you for the purposes described below.

 

What information do we collect?

BMC may collect, use, store and transfer different kinds of Personal Data about you. Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).
These are the types of Personal Data we may collect:

  • Identity Dataincludes first & last name, Company, job title.
  • Contact Dataincludes billing address, delivery address, email address and telephone numbers.
  • Financial Dataincludes bank account and payment card details if you make purchases from us.
  • Transaction Dataincludes details about payments to and from you and other details of products and services you have purchased from us.
  • Technical Dataincludes internet protocol (IP) address, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
  • Usage Dataincludes information about how you use our website, products and services.
  • Marketing and Communications Dataincludes your preferences in receiving marketing from us and your communication preferences.

We also collect and use Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your Personal Data but is not considered Personal Data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this privacy notice.

We do not collect any Special Categories of Personal Data about you while you visit the Site (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.

What do we use this information for?

We will only use your Personal Data when the law allows us to. We must use your data only on a lawful basis including, but not limited to using such data to fulfil a contract we have with you; to comply with legal obligations; to lawfully gain information to help us develop our services; to monitor how our website is being used; for marketing and communications purposes (as set forth below) to keep you informed of developments and new products; to identify issues with our website etc. that we need to fix. By providing us your Personal Data you indicate that you consent to allow us to process and maintain your Personal Data.
Most commonly, we will use your Personal Data in the following circumstances:

  • BMC may collect information in conjunction with registration for programs and related services and to perform follow-up with its program registrants, as part of the registration process for BMC programs.
  • Where we need to perform the contract we are about to enter into or have entered into with you to provide you with BMC services available to you.
  • We may use your IP Address to help diagnose problems with our server, and to administer BMC’s Site.
  • Your IP Address may also be used to help identify you and to gather broad demographic information.
  • We may also use your IP address to track information you have seen on our Site.
  • We may use your name, email address and mailing address to assist us in communicating with you.
  • Where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal or regulatory obligation.
  • Marketing
    We may use your Identity, Contact, Technical, and Usage to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).
    You will receive marketing communications from us if you have requested information from us or purchased goods or services from us or if you provided us with your details when you registered for a promotion and, in each case, you have not opted out of receiving that marketing.
    We will not supply your details to any company outside BMC for marketing purposes. Currently, only we will contact you for marketing purposes. If in the future we ask a third party approved by us to contact you in order to fulfill the services we provide to you we will ensure that we have a GDPR agreement with that third party regarding the use of any data we supply them about you for the purposes of their contacting you.
    If we mistakenly email an individual, the individual should use the opt out/ unsubscribe link at the bottom of every email, and inform us of our error at hello@bluemesagroup.com.

Opting out of marketing messages

You can ask us to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us at hello@bluemesagroup.com. Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of a product/service purchase, registration, product/service experience or other transactions.

Data retention

We will only retain your Personal Data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
We will actively review the information we hold and when there is no longer a customer, legal or business need for us to hold it, we will either delete it securely or in some cases anonymize it.
To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.
By law, we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.
In some circumstances, you can ask us to delete your data.
In some circumstances, we may anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

With whom do we share your information?

We will not sell, share or rent personal information to others except in accordance with this Policy.

We require all third parties to respect the security of your Personal Data and to treat it in accordance with the law. We do not allow our third-party service providers to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.

Disclaimer of Responsibility for Privacy Policy And Content At Linked Sites

BMC’s Site may provide you with links to other websites. We are not responsible for those sites and cannot control the use of information that you submit once you reach those sites, nor can we control the content of what is offered on those sites or on links from those sites.

Use of Cookies

Cookies are a standard technology used by commercial web services to store small pieces of information on your hard drive by sending a small string of text to your browser. Cookies make your use of our Site more pleasing and efficient by, for example, ‘personalizing’ your user interface or identifying which parts of a site you have previously visited. Most web browsers automatically accept cookies unless you have configured yours not to accept them. In order for us to provide you with services, your browser must accept cookies, as they are essential for site administration and security. We also use cookies to tailor the information that you receive and for other purposes.
You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly. As stated earlier cookies are primarily used to inform our marketing activities and to see what is popular on our site.

Security

BMC takes great precautions to protect our users’ personal information. When users submit sensitive information via the Site, the information is protected both online and off-line through information that is encrypted and protected with a widely accepted industry standard encryption protocol – SSL.
In addition to using SSL encryption to protect sensitive information online, we protect users’ information off-line. Access to all of our users’ information, not just the sensitive information mentioned above, is restricted. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information that others do not have access to. Furthermore, all employees are kept up-to-date on our security and privacy practices. Any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy and what they can do to ensure that our users’ information is protected.
We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach when we are legally required to do so.

How is your Personal Data collected?

We use different methods to collect data from and about you are including through:
Direct interactions. You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes Personal Data you provide when you:

  • apply for our products or services;
  • subscribe to our service or publications;
  • request marketing to be sent to you;
  • enter a competition, promotion or survey; or
  • give us some feedback.
  • Automated technologies or interactions. As you interact with the Site, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this Personal Data by using cookies and other similar technologies.

Children

In compliance with the Children’s Online Privacy Protection Act, BMC will not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for the Site or send any information about yourself to us, including your name, address, telephone number, or email address.
